IS THE KDF AMENDMENT BILL 2015 A SCHEME TO SECURE SECOND TERM AND BEYOND FOR PRESIDENT UHURU KENYATTA?<br />
<br />
Following critical analysis of the KDF Amendment Bill 2015, which proposes inter alia, to give the military a role in civilian operations contrary to the Constitution, the true intention of the drafters of the said Bill has now needs to be laid bare.<br />
<br />
First, Article 241 of the Constitution of Kenya explicitly spells out the structure and composition of KDF and its role. In particular, Article 241 (4) states that “The composition of the Command by the Defence Forces shall reflect the regional and ethnic diversity of the people of Kenya. However, the KDF Amendment Bill contravenes this provision by proposing to abolish the requirement for KDF to advertise slots per counties during military recruitment. Such proposal is likely to further ethnize the military.<br />
<br />
Second, whereas Article 201 of the Constitution of Kenya (Principles of Public Finance) states that “There shall be openness and accountability including public participation in financial matters”, the KDF Bill bars the public and law makers from scrutinising the budgetary allocations and military spending. This could open a flood gate for mega corruption in the military sector.<br />
<br />
Third, the KDF Amendment Bill contravenes Article 239 (5) of the Constitution which states that “The National Security Organs are subordinate to civilian authority. This is so because the Bill gives KDF acarte blanche for intervention in all sectors without due limitation or restriction.<br />
<br />
Forth, the KDF Amendment Bill inadvertently opens a Pandora’s box for corruption within the forces by proposing that KDF holds a separate account from that of the Ministry of Defence. This is apparently crafted to shield KDF from any financial probe by the Auditor General.<br />
<br />
Fifth, the KDF Amendment Bill will certainly entail amendment of the Constitution, the Kenya Wildlife Act, Kenya Police Service Act and the NYS Act to allow for its operationalization. Certainly, the Jubilee government is not prepared for such undertaking<br />
Sixth, a closer scrutiny of the KDF Amendment Bill reveals that it is a cut and paste work on the existing Uganda People’s Defence Forces (UPDF) Act which fails to draw a clear demarcation between police and military roles and thereby politicizes the military to serve as an appendage to the ruling civilian executive.<br />
<br />
This is the case with such laws in Rwanda, Uganda, Burundi, Republic of Sudan, Zimbabwe and other totalitarian regimes in Africa where serving heads of state have had their terms of office unilaterally extended or have been made life President. It is feared that this could be a precursor to institutionalized electoral rigging through military intimidation as is the usual case in Zimbabwe, Uganda, Rwanda and Burundi.<br />
<br />
<br />
Indeed, the KDF Amendment Bill 2015 could be an attempt to ensure second and subsequent terms for President Uhuru Kenyatta. And this could be the beginning of greater political turmoil for Kenya and must therefore be opposed vigorously by all the citizens of the Country.

Former Prime Minister Raila Odinga has warned President Uhuru Kenyatta against using President Barrack Obama’s meeting with the Opposition to divert Kenyans’ attention from important matters.<br />
<br />
Speaking at a rally in Ahindi on Friday, Raila, who was accompanied by several CORD MPs, cautioned the Government against using Obama’s meeting with the Opposition to divert the attention of Kenyans from issues affecting the nation.<br />
<br />
“Our meeting with Obama was private. President Kenyatta should not lie to the nation. Obama told the Government to fight corruption and promote national unity. These are the issues the President should be telling Kenyans how he is handling them,” Raila said.<br />
<br />
“We told Obama to help reform the Independent Electoral and Boundaries Commission (IEBC) by establishing a reputable ICT platform so that future elections are not stolen. We also told him to assist Kenya achieve the one third gender rule because the Jubilee Government is not ready to implement it. This is not betrayal,” Raila added.<br />
<br />
Raila’s sentiments were echoed by Siaya Senator, James Orengo, who wondered whether Uhuru was eavesdropping on their meeting.<br />
<br />
“Obama, in all his speeches, was rebuking the Government. When we met Obama, we were just comparing notes,” said Orengo.

Tanzania musician, Ray C, has decided to give First lady Margaret Kenyatta sleepless nights by declaring that she is in love with Kenya’s President, Uhuru Kenyatta.<br />

Through her instagram page on Saturday, the musician whose real name is Rehema Chalamila, said she loves Uhuru to “death”.<br />
<br />
“Lemme tell you a lil secret about Uhuru!!! I love this guy to death! I have had a crush on him for soooo long!!!” the musician said.<br />
<br />
She further admitted that she day dreams about the President and even spends a day admiring his pictures on social media.<br />
<br />

Tuesday Kenyans once again woke up to very disturbing news of an Al Shabaab attack in Mandera town that left 14 Kenyans dead and several others injured.<br />
<br />
The terrorist group is said to have crept in in the wee hours of the night and sprayed bullets indiscriminately on quarry workers as they slept in their tents.<br />
<br />
It was yet another attack by Al shabaab in 2015. In April, Kenya lost 148 people when the killer group invaded Garissa University College, leaving the country mourning for its loved ones for days.<br />
<br />
And following Tuesday's attack, President Uhuru personally visited survivors in their hospital beds to console them.<br />
<br />
The head of state could not, however, hide his anger at the manner in which innocent Kenyans were being mistreated by the insurgents, and it manifested itself as tears engulfed his eyes.<br />
<br />
The war against terrorism has been the major challenge that the Jubilee government is dealing with to date.<br />
<br />

President Uhuru Kenyatta has moved to calm the prevalent debate over homosexuality ahead of an anticipated visit by US President, Barrack Obama, who is a gay and lesbian advocate.<br />
<br />
Through State House Spokesman, Manoah Esipisu, Uhuru said Kenya is a country governed by the Constitution and that President Obama is free to speak about homosexuality while in Kenya.<br />
<br />
Uhuru highlighted the importance of freedom of speech saying he cannot dictate what President Obama can or cannot say during his visit to Kenya.<br />
<br />
“As Kenyans, we believe in freedom of speech. We cannot tell Obama what he can or cannot say during his visit to Kenya,” Esipisu said on behalf of Uhuru.<br />
<br />
This comes barely a day after Deputy President William Ruto warned Obama to steer clear of the gay and lesbian debate while in Kenya saying Kenya is a God-fearing nation and will not allow the US President to bring his homosexuality agenda to the country.<br />
<br />
Kenyans, among them Deputy President William Ruto, are worried that Obama may use his presence in the country later this month to advocate for same sex marriages, something they vowed never to let happen.<br />
<br />
However, as it appears, Obama has the backing of Uhuru and may go ahead to tell Kenyans to embrace same sex marriages in Kenya.<br />

Central Kenya youths have welcomed the destruction of illicit brew dens going on in the region after President Uhuru ordered the exercise to be carried out by the police, NYS youths and elected leaders without fear or favour.<br />

He was killed by an unknown person in a bar yesterday after a brawl at Club Resort, a popular pub in Migori Town.<br />
<br />
Obondo, who is a known thug and gun for hire in Migori, was stabbed to death by his attacker after a short quarrel.<br />
<br />
When the news of his death came to the fore, there was little celebration and a sigh of relief from Migori residents, who say that he has been terrorizing them for years.<br />
<br />
Many of his victims, some of who are nursing serious injuries, ranging from stab wounds to acid burns, thanked the man who killed him saying the town was now free.<br />
<br />
Before his death, Obondo, who was a gun for hire and worked closely with a two-term MP from Migori County, was on the run from the police who were looking for him to face justice for over 15 cases against him.<br />
<br />
The incident in Migori where he hurled a shoe at Uhuru attracted nationwide condemnation that prompted Governor Okoth Obado to lead a delegation from Nyanza to State House to apologize to the President.<br />
<br />
His killer is yet to be identified but police say they are on top of things to unmask him.<br />

President Uhuru Kenyatta has been voted Africa’s President of the year 2014-2015 for his outstanding leadership.<br />
<br />
The Head of State was picked for the prestigious Africa Education and Leadership Awards for his ability to build consensus locally and abroad and his efforts to change policies for the better and supervise solutions that address Kenya’s pressing issues.<br />
<br />
Thousands of university students from institutions of higher learning in Africa also recognised President Kenyatta for initiating progressive economic programmes aimed at uplifting the lives of Kenyans.<br />
<br />
The students, who are members of the All-Africa Students Union (AASU), presented President Kenyatta with the award, which, among other things, celebrates “outstanding leadership and educational excellence”.<br />
<br />
The AASU is based in Accra, Ghana.<br />

<b>PROTEST</b><br />

AASU student leaders, drawn from 12 local universities, presented the award to the President at State House in Nairobi.<br />
<br />
They were led by AASU East African representative Lone Felix of Kenyatta University.<br />
<br />
They were accompanied by Education Cabinet Secretary Jacob Kaimenyi , PS Belio Kipsang and a team from the Kenya Private Sector Alliance.<br />
<br />
President Paul Kagame of Rwanda is a previous recipient of the award.<br />
<br />
The President said it was important for students to engage the Education ministry when they have issues instead of taking to the streets to protest.<br />
<br />
“You should engage the ministry (of Education) in a more constructive manner without going to the streets and throwing stones”, the President told the student leaders, who also told the Head of State they needed more funding from the Higher Education Loans Board.<br />
<br />
The President instructed Prof Kaimenyi and head of Public Service Joseph Kinyua to explore how the students can be funded to hold the next AASU summit in Nairobi later in the year.<br />
<br />
He said it is necessary to establish more incubation centres where students can nurture their skills and develop their innovative ideas.<br />
<br />
President Kenyatta said he was excited by incubation centres where young people are developing products and exploring economic opportunities.<br />

Kenya’s President Uhuru Kenyatta has told Burundi leader Pierre Nkurunziza that he should postpone a presidential election due next month after last week’s failed military coup, Kenyatta’s spokesman said on Monday. Manoah Esipisu said the two leaders, whose nations belong to the East African Community (EAC) common market, had spoken by phone on Sunday. </div>

Kenyatta’s counterparts in the region shared his view, he added. On Tuesday, heavily armed soldiers were deployed in the capital, Bujumbura, days after the failed coup attempt that followed widespread protests against Nkurunziza’s decision to seek a third term. In the Musaga neighbourhood, armed soldiers faced off on Tuesday with hundreds of angry protesters calling on Nkurunziza to rescind his decision, which many say is unconstitutional. </div>

An Associated Press reporter in Musaga saw two soldiers firing live rounds into a crowd of protesters, who repeatedly shouted, “Shoot us.” The soldiers were seen armed with machine guns and rocket-propelled grenade launchers. There was no police presence, signaling the army, which previously had acted as a buffer between protesters and the police, has now taken over operations against demonstrators. Regional leaders want the election date changed from June 26 to create a “conducive environment” but the vote should still be held within the current electoral cycle, which comes to an end in late August, Kenya’s Esipisu said. </div>

Making his first appearance in the capital since last week’s attempted coup, Nkurunziza said on Sunday that he has been battling a threat from Somali armed group al-Shabab. “We are very preoccupied by al-Shabab’s well-known attack. You know that Burundi has contributed to sending troops to Somalia so we came here to contact our friends and colleagues here in Kenya as well as in Uganda,” Nkurunziza said. “Both are privileged targets for al-Shabab. The agenda is to put in place proactive measures to face these attacks that are a security risk to the citizens of Burundi.” The landlocked east African nation has been plunged into crisis since Nkurunziza pushed for a third term of office, a move his opponents say breaks the constitution and a 2005 peace agreement that ended an ethnically driven civil war. </div>

Speaking during a media interview, Ruto blasted the Jubilee Government, especially the URP wing of Government, for being the greatest threat to devolution among other things.<br />

He accused the Deputy President of being the face of impunity in Government with his dictatorial tendencies which has seen him arbitrarily suspend 9 MCAs from Bomet County for refusing to support his impeachment as Governor.<br />
<br />
Asked why he hates the Jubilee Government that much to the extent of leading a rebel group within Jubilee, the Bomet Governor said he had no problem with President Uhuru Kenyatta and his TNA party, because they are good people.<br />
<br />
He said his only problem and headache was Deputy President William Ruto and URP, a problem he said he must eliminate for his own good and the good of the people of Rift Valley.<br />
<br />
“I have no problem with Uhuru, William Ruto is my problem which I must do away with to stay alive politically. He has become a dictator and unbearable to put up with in URP,” said the Bomet Governor.

Suspended Deputy Head of Mission at Kenya’s embassy in South Africa Jane Waikenda has been posted to Algeria despite being  among officials suspended after names appeared in list of shame.<br />
<br />
Waikenda who escaped the anti-corruption dragnet while working at Immigration, where she faked illness, had been posted to South Africa to evade criminal culpability.<br />
<br />
The Ethics and Anti-Corruption Commission had narrowed on her for irregularly issuing work permits to foreigners when she was Director of Immigration.<br />
<br />
The inquiry reportedly revolves around issuance of around 300 work permits in October 2013, which the EACC suspects were irregular.<br />
<br />
According to a confidential letter dated April 19, written by Foreign Affairs PS Karanja Kibicho, she is expected to report to her new station, Algiers, on or before July 1.<br />
<br />
Waikenda, a close confidante of President Uhuru, is the first of a number of officials expected to return to their stations after the dust of ‘fighting corruption’ has settled. She is mother to Michael Waikenda, a TNA youth leader.<br />
<br />
When she took over at immigration, it is alleged she forced all the civil servants to have a copy of the TNA manifesto. She also alleged to have suspended a number of senior officials who didn’t come from her tribe in what she claimed was ‘cleansing’ the immigration department from ghosts of former immigration minister Otieno Kajwang.<br />
<br />
Her posting, despite being under investigations, dismisses all claims that President Uhuru Kenyatta is genuine in fight against corruption. It vindicates critics of the president who have all along accused him of shielding people around and closer to him accused of corruption.

Despite calls by African Gospel Church Bishop Dr Robert Langat to politicians attending yesterday’s fundraising in Bomet for the church, politicians allied to Deputy President William Ruto went against it and played politics.<br />

Kanu Secretary General Nick Salat said it was unfortunate that the church function was hijacked by politicians from one side despite an earlier agreement by all leaders to respect sanctity of the church.<br />
<br />
“Some leaders came out guns blazing despite an agreement agreed on after two days of meetings with church leaders that politics would be left aside,” he said.<br />
<br />
He said Governor Isaac Ruto stayed clear of politics to avoid polarising the event and dismissed those who believed that the governor was subdued as dishonest.<br />
<br />
“Some people have gone back to Nairobi thinking they have subdued their opponents. Let them day dream,” said Salat.<br />
<br />
“It is unfortunate that people cannot be trusted to honour even such a gentleman’s agreement and they want to be taken seriously as leaders,” said the Kanu SG.<br />
<br />
Kanu through its chairman Gideon Moi together with Governor Ruto have on several occasions held joint functions in the region sending shivers in Deputy President’s camp that the two were working on a political alliance as an alternative for the residents dissatisfied with the Jubilee government.<br />
<br />
Rift Valley residents have raised issues with the way the Jubilee government has handled farmers issue, Mau evictions and appointments to public offices that has tilted more to rewards to DP Ruto’s cronies in the region instead of merit.<br />
<br />
Salat faulted government’s timing on eviction of squatters from Narok section of Mau forest during the rainy season, saying it exposed evictees to harsh weather.<br />
<br />
Hundreds of residents who turned up yesterday at a funds drive presided over by President Uhuru Kenyatta in Bomet had demanded Salat be given an opportunity to address them.<br />
<br />
Deputy Speaker of the National Assembly Joyce Laboso, who was the master of ceremonies, was forced to bow to pressure during the funds drive at the Bomet Green Stadium for African Gospel Church after a Sunday service.<br />
<br />
Salat also urged the Government to give subsidised maize seeds to farmers who suffered a total crop failure in the past planting session.<br />
<br />
Salat added that tea farmers in the region needed assistance because of the falling prices of the commodity in the international market and may fail to services their loans.<br />
