The High Court has today ordered the Jubilee Government to respond to issues raised by CORD in an urgent application today challenging the constitutionality of the recently passed security law.
While issuing the order, Justice Isaac Lenaola however declined to suspend the bill as CORD had prayed, opting to hear ex-parte the government side before giving further orders.
CORD lawyers, led by Senior Counsels James Orengo and Amos Wako opposed several provisions of the new law citing numerous unconstitutional issues with it.
While making the presentation, Orengo told Lenaola the new law fundamentally changes procedures in criminal law and abrogates fair administration of justice.
Lenaola directed the Government to represent itself before the court before he makes a ruling tomorrow at 10 am.
Orengo was accompanied by former Prime Minister, Raila Odinga, former Vice President, Kalonzo Musyoka and Bungoma Senator, Moses Wetangula.
Lawyers who accompanied Orengo include Judy Sijeny, Antony Oluoch, Paul Mwangi, Daniel Maanzo and Mombasa Senator Hassan Omar Sarai.
